This is the step that surprises almost everyone — Arizona is one of only three states (with Nebraska and New York) that requires new LLCs to publish a formation notice in a newspaper. The good news: if your statutory agent's address is in Maricopa or Pima County, you're completely exempt. Here's exactly what to do either way.
Within 60 days of ACC approval, most Arizona LLCs must publish a Notice of Formation in an approved newspaper in the same county as their statutory agent, for three consecutive publications. Cost typically runs $80–$120 (up to $300 in some counties). LLCs with a statutory agent in Maricopa or Pima County are fully exempt — the ACC publishes the notice online automatically at no cost.

Why Arizona Requires This
Arizona is one of only three states — alongside Nebraska and New York — that still requires new LLCs to publish a formation notice in a newspaper. Under A.R.S. § 29-3201(G), the point is to put the public "on notice" that a new business entity exists. It's a holdover from before digital business registries, and it's the step most other state guides don't fully prepare you for.

How to Complete Publication (Outside Maricopa/Pima)
- Get your Notice of Publication form — the ACC sends this along with your approval letter (Form LL-0001), or you can use a compliant sample.
- Choose an approved newspaper in the same county as your statutory agent's address — the ACC's approval letter includes a list.
- Submit for 3 consecutive publications — typically running over 1–2 weeks depending on the newspaper's schedule. Ask about cost, payment method, and turnaround before committing.
- Receive your Affidavit of Publication — the newspaper mails this 2–4 weeks after your last run, confirming compliance.
- Keep the affidavit with your records. Filing it with the ACC is no longer required, but recording it with them (free, via email or mail) is a smart extra layer of proof.
Filing the affidavit with the ACC is optional nowThis used to be mandatory, but it's not anymore. You're only legally required to keep a copy of the Affidavit of Publication with your own business records. That said, recording it with the ACC is free and creates an official state record — worth doing in case the question of compliance ever comes up later (for example, during a TPT license application).
Missing the 60-day window is a real riskFailure to complete the newspaper publication requirement within 60 days is grounds for administrative termination of your LLC under Arizona law. It doesn't happen instantly — you'll typically get a warning letter first — but don't treat this as a soft deadline.
