What Idaho Requires
Idaho Code §30-21-102(36) and §30-25-201(2)(i)(ii) set the rules for who can serve as a registered agent:
- Physical Idaho street address — a P.O. box alone is not acceptable; the agent must be reachable at a real street address in the state.
- An individual Idaho resident — this can be you, a co-owner, a friend, or an employee, as long as they live in Idaho.
- Or a registered business entity — a commercial registered agent company registered with the Secretary of State's office.
- Assumed Business Names can't serve as agents — a business operating only under an Idaho trade name filing (not a registered entity) cannot act as anyone's registered agent.
- Available during business hours — the agent needs to be reliably present to accept service of process (legal documents) when delivered.
