What Is an ITIN?

An ITIN application gives you an Individual Taxpayer Identification Number — a nine-digit number the IRS issues to people who have a US tax filing or reporting obligation but aren't eligible for a Social Security Number (SSN). Every ITIN begins with the digit "9."

An ITIN exists for one purpose: federal tax processing. It lets you file a US tax return, be claimed on one, or satisfy a US reporting requirement. It is available to residents and nonresidents alike, regardless of immigration status.

Just as important is what an ITIN is not. It does not authorize you to work in the US, it does not provide Social Security benefits, it does not change your immigration status, and it does not make you eligible for the Earned Income Tax Credit.

SSN-eligible? You can't get an ITIN.If you qualify for a Social Security Number, you must apply for an SSN instead — the IRS will not issue an ITIN to anyone eligible for an SSN. The ITIN exists specifically for people who have a US tax obligation but no path to an SSN.

Do You Actually Need an ITIN? (LLC Owners, Read This)

This is the single biggest point of confusion for foreign business owners, so let's clear it up: you do not need an ITIN to form a US LLC, and you do not need one to get an EIN. These are different numbers for different jobs.

So when does a non-resident LLC owner actually need an ITIN? Typically when you have to file a personal US tax return — for example, a 1040-NR because your LLC has effectively connected US income — or when you need to claim a tax treaty benefit, or you're a partner receiving a Schedule K-1. If you're only forming the LLC and getting an EIN, you can usually wait.

A complete ITIN application has three parts: Form W-7, proof of identity and foreign status, and (usually) a federal tax return.

ITIN Application Requirements — Documents & Form W-7

A complete ITIN application has three components. Missing any one of them is the most common reason applications get rejected:

1. Completed Form W-7

The ITIN application form itself. You select your reason for applying (boxes a–h), enter your name, foreign address, birth details, and — if renewing — your existing ITIN. It must be signed in ink; it cannot be e-filed.

2. Proof of Identity & Foreign Status

A valid passport is the only single document that proves both identity and foreign status. Without one, you provide a combination of two from the IRS-approved list (national ID, birth certificate, visa, etc.). Documents must be originals or certified copies from the issuing agency — notarized copies are not accepted — and must be current.

3. Your Federal Tax Return

In most cases you must attach the US tax return the ITIN is for (such as a 1040-NR). The IRS processes them together. You can skip the return only if you qualify for a specific Exception — for example, certain treaty-benefit, third-party-withholding, or partnership-reporting situations — which you must document.

Never mail your only passport casuallyIf you mail original documents, the IRS holds them during processing (often 7–11 weeks) before returning them. For most non-residents that's a non-starter — which is exactly why the Certified Acceptance Agent route below exists.

How to Submit Your ITIN Application (3 Methods)

There's no online ITIN application — Form W-7 must be submitted one of three ways. They differ mainly in whether you have to part with your original documents:

Ahmad Adil's Take:If you're outside the US, use a Certified Acceptance Agent — full stop. The CAA fee (commonly a few hundred dollars) buys you two things worth far more than the money: you never let your passport out of your hands, and a trained agent catches the document and Exception-code errors that cause most rejections. Mailing your original passport across the world and waiting two-plus months to get it back is a risk I'd never take. And remember the sequence for business owners: form the LLC, get the free EIN, and only file the ITIN application when a real personal tax filing requires it.
