What Is an EIN and Why Does Your Florida LLC Need One?
An EIN (Employer Identification Number) is a 9-digit federal tax identification number assigned by the IRS in the format XX-XXXXXXX. It functions like a Social Security number for your business — it identifies your LLC to the IRS, to banks, and to vendors who need to report payments to you.
For your Florida LLC, the EIN is the key that unlocks the practical next steps after formation. Without it, you can't open a business bank account, and without a business bank account, you're co-mingling finances and undermining your liability protection from Step 3.
An EIN is always free from the IRS.Never pay a third-party website or service for an EIN. Sites that charge $50–$200 for EIN filing are simply completing the free IRS form on your behalf — a service you don't need. The IRS application at IRS.gov is free, takes about 10 minutes, and delivers your EIN instantly online.
Does Your Florida LLC Need an EIN?
You are required to get an EIN if your Florida LLC:
- Has more than one member — multi-member LLCs are taxed as partnerships and must have an EIN for tax filing
- Has or plans to hire employees — required for payroll tax filings and W-2s
- Elects S-Corp or C-Corp tax treatment — corporate tax elections require an EIN
- Opens a business bank account — virtually every US bank requires an EIN for a business account
Even if none of the above apply, single-member LLC owners should still get an EIN. It protects your SSN from being shared with clients and vendors, satisfies bank requirements, and is instant and free. There's no downside to having one.
3 Ways to Apply — Which to Use
Online (IRS.gov)
Available to US residents with an SSN or ITIN. The IRS online application confirms your EIN immediately. Available Monday–Friday, 7am–10pm ET. Apply at IRS.gov — it's free.
Fax (Form SS-4)
Fax a completed Form SS-4 to 855-215-1627 (US applicants). The IRS faxes your EIN back in about 4 business days. Best for non-residents or those who can't use the online tool.
Mail (Form SS-4)
Mail Form SS-4 to the IRS. Takes up to 4 weeks. Use only if other methods aren't available — there's no benefit over fax or online.
Non-US residents:If you don't have an SSN or ITIN, you cannot use the online tool. Apply by phone at +1-267-941-1099 (Mon–Fri, 6am–11pm ET) for an immediate EIN, or fax Form SS-4 to +1-304-707-9471 (international). Attach a copy of your passport to the faxed form. How to Apply for Your EIN Online (Step by Step)
- Go to IRS.gov and navigate to the EIN Online Assistant (linked above). Click "Apply Online Now."
- Select your entity type: choose "Limited Liability Company (LLC)" from the list.
- Select the number of LLC members: 1 (single-member) or 2 or more (multi-member). This determines the default tax treatment.
- Select the state where your LLC was organized: Florida.
- Select your reason for applying: choose "Started a new business" for a newly formed Florida LLC.
- Enter the responsible party — the individual who owns, controls, or manages the LLC. This must be a real person (not another LLC or corporation). Enter their name and SSN or ITIN.
- Enter your LLC's legal name exactly as it appears on your approved Sunbiz filing, including the designator (e.g., "Oak Street Consulting LLC").
- Enter your LLC's mailing address and the date your LLC was formed (the date on your Sunbiz approval email).
- Answer whether the LLC has or expects to hire employees in the next 12 months, and the principal business activity.
- Review all information and submit. Your EIN is issued immediately. Download and save the confirmation notice — this is your official EIN document.
Save the confirmation notice (CP 575)The IRS mails a CP 575 notice confirming your EIN — keep this permanently. You can also download a confirmation letter immediately from the online tool. If you lose your EIN, you can retrieve it by calling the IRS Business & Specialty Tax Line at 800-829-4933 (Mon–Fri 7am–7pm local time) — they can confirm your EIN once you verify your identity.
The Responsible Party Rule — What You Need to Know
The IRS requires every EIN application to name a responsible party — the individual who owns, controls, or manages the LLC and its assets. For most Florida LLCs, this is the member (owner).
- Must be a real individual person — not another LLC, corporation, or trust
- Must provide their SSN, ITIN, or existing EIN on the application
- Nominees cannot be listed as responsible party — the IRS explicitly prohibits this
- Only one EIN per responsible party per day — the IRS limits applications regardless of method
If the responsible party changes (for example, a new member takes control), you must report the change to the IRS within 60 days using Form 8822-B.
What to Do After You Receive Your EIN
Once you have your EIN confirmation, you have three immediate things to do — in this order:
- Save the confirmation permanently — file the CP 575 notice with your other formation documents (Articles of Organization, OA, and Sunbiz printout).
- Set up your business online presence — before opening the bank account in Step 6, claim your domain and set up a professional email address using your LLC name. Banks and vendors expect a business email.
- Open your Florida LLC business bank account — you'll need your EIN, Articles of Organization, and operating agreement. Step 6 covers the annual report, and after that you're fully operational.
