What Is an EIN and Why Does Your Florida LLC Need One?

An EIN (Employer Identification Number) is a 9-digit federal tax identification number assigned by the IRS in the format XX-XXXXXXX. It functions like a Social Security number for your business — it identifies your LLC to the IRS, to banks, and to vendors who need to report payments to you.

For your Florida LLC, the EIN is the key that unlocks the practical next steps after formation. Without it, you can't open a business bank account, and without a business bank account, you're co-mingling finances and undermining your liability protection from Step 3.

An EIN is always free from the IRS.Never pay a third-party website or service for an EIN. Sites that charge $50–$200 for EIN filing are simply completing the free IRS form on your behalf — a service you don't need. The IRS application at IRS.gov is free, takes about 10 minutes, and delivers your EIN instantly online.

Does Your Florida LLC Need an EIN?

You are required to get an EIN if your Florida LLC:

  • Has more than one member — multi-member LLCs are taxed as partnerships and must have an EIN for tax filing
  • Has or plans to hire employees — required for payroll tax filings and W-2s
  • Elects S-Corp or C-Corp tax treatment — corporate tax elections require an EIN
  • Opens a business bank account — virtually every US bank requires an EIN for a business account

Even if none of the above apply, single-member LLC owners should still get an EIN. It protects your SSN from being shared with clients and vendors, satisfies bank requirements, and is instant and free. There's no downside to having one.

How to Apply for Your EIN Online (Step by Step)

Apply for EIN Online — IRS.gov (Free)Instant EIN · Available Mon–Fri 7am–10pm ET · Requires SSN or ITIN
Go to IRS EIN Application
  1. Go to IRS.gov and navigate to the EIN Online Assistant (linked above). Click "Apply Online Now."
  2. Select your entity type: choose "Limited Liability Company (LLC)" from the list.
  3. Select the number of LLC members: 1 (single-member) or 2 or more (multi-member). This determines the default tax treatment.
  4. Select the state where your LLC was organized: Florida.
  5. Select your reason for applying: choose "Started a new business" for a newly formed Florida LLC.
  6. Enter the responsible party — the individual who owns, controls, or manages the LLC. This must be a real person (not another LLC or corporation). Enter their name and SSN or ITIN.
  7. Enter your LLC's legal name exactly as it appears on your approved Sunbiz filing, including the designator (e.g., "Oak Street Consulting LLC").
  8. Enter your LLC's mailing address and the date your LLC was formed (the date on your Sunbiz approval email).
  9. Answer whether the LLC has or expects to hire employees in the next 12 months, and the principal business activity.
  10. Review all information and submit. Your EIN is issued immediately. Download and save the confirmation notice — this is your official EIN document.

Save the confirmation notice (CP 575)The IRS mails a CP 575 notice confirming your EIN — keep this permanently. You can also download a confirmation letter immediately from the online tool. If you lose your EIN, you can retrieve it by calling the IRS Business & Specialty Tax Line at 800-829-4933 (Mon–Fri 7am–7pm local time) — they can confirm your EIN once you verify your identity.

The Responsible Party Rule — What You Need to Know

The IRS requires every EIN application to name a responsible party — the individual who owns, controls, or manages the LLC and its assets. For most Florida LLCs, this is the member (owner).

  • Must be a real individual person — not another LLC, corporation, or trust
  • Must provide their SSN, ITIN, or existing EIN on the application
  • Nominees cannot be listed as responsible party — the IRS explicitly prohibits this
  • Only one EIN per responsible party per day — the IRS limits applications regardless of method

If the responsible party changes (for example, a new member takes control), you must report the change to the IRS within 60 days using Form 8822-B.

What to Do After You Receive Your EIN

Once you have your EIN confirmation, you have three immediate things to do — in this order:

  • Save the confirmation permanently — file the CP 575 notice with your other formation documents (Articles of Organization, OA, and Sunbiz printout).
  • Set up your business online presence — before opening the bank account in Step 6, claim your domain and set up a professional email address using your LLC name. Banks and vendors expect a business email.
  • Open your Florida LLC business bank account — you'll need your EIN, Articles of Organization, and operating agreement. Step 6 covers the annual report, and after that you're fully operational.

Frequently Asked Questions

Florida LLC EIN — FAQs

How much does an EIN cost for a Florida LLC?
$0 — always free. The IRS provides the EIN application at no charge through its online tool at IRS.gov. Never pay a third-party service for an EIN. Sites charging $50–$200 are completing the same free IRS application on your behalf — a service you simply don't need. The process takes about 10 minutes and you receive your EIN instantly online.
Can I get an EIN before my Florida LLC is approved?
Technically yes — the IRS doesn't verify your LLC's status with Florida before issuing an EIN. However, it's best practice to wait until your Sunbiz approval email arrives and you have your LLC's Document Number, because you'll need the exact legal name and formation date for the EIN application. Applying after approval takes the same 10 minutes and avoids any potential mismatch between your IRS and Sunbiz records.
Do I need an EIN for a single-member Florida LLC?
Not strictly required by the IRS if you have no employees and don't elect corporate tax treatment — a single-member LLC is taxed as a disregarded entity and can use the owner's SSN. However, you should get one anyway: most banks require an EIN to open a business account, it protects your SSN from clients and vendors who need to issue 1099s, and it costs nothing. It's always the right move.
What is a "responsible party" on an EIN application?
The responsible party is the individual who owns, controls, or manages the LLC and its assets. For most Florida LLCs, this is the owner (member). It must be a real person — not another LLC, trust, or corporation — and must provide their SSN or ITIN. The IRS prohibits listing a nominee (someone who isn't the actual controller) as the responsible party. If the responsible party changes later, you must notify the IRS within 60 days using Form 8822-B.
Can a non-US resident get an EIN for a Florida LLC?
Yes — but not through the online tool, which requires an SSN or ITIN. Non-residents apply by phone at +1-267-941-1099 (Mon–Fri, 6am–11pm Eastern) for an immediate EIN, or by faxing Form SS-4 to +1-304-707-9471 (international) with a copy of their passport. The fax method takes about 4 business days. See our full guide at EIN without SSN.
What do I do if I lose my Florida LLC's EIN?
Call the IRS Business & Specialty Tax Line at 800-829-4933 (Mon–Fri, 7am–7pm local time). They can verify your identity and confirm your EIN over the phone. You can also find it on previously filed tax returns, on the original CP 575 confirmation notice, on bank account paperwork, or on any W-9 form you've completed. You cannot apply for a new EIN for the same entity — each LLC has exactly one EIN permanently.
Can I use my SSN instead of an EIN for my Florida LLC?
Technically yes for a single-member LLC with no employees, but it's not recommended. Using your SSN for business purposes exposes it to clients, vendors, and anyone who receives a 1099 from you — a significant identity theft risk. An EIN is a free, immediate alternative that keeps your SSN private. Most banks also require an EIN to open a business account regardless of LLC structure.
